Terms & Conditions

Last updated: October 2026

These terms apply to every quotation, booking and production agreed between Chris Valencia Media (“the Producer”) and a client (“the Client”). By signing a quotation, the Client accepts these terms. If a signed quotation differs from this page, the signed quotation prevails.

1. Quotations and booking

Quotations are valid for 15 days from the date shown. A production date is reserved once the Producer receives the signed quotation or written approval by email. For events, when Chris Valencia Media is not registered as a vendor of the Client, a 50% deposit is due upon acceptance and signature of the quotation or contract, and the remaining 50% is due upon delivery.

2. Scope of production

The scope is defined in the quotation and its Production Specifications page: coverage, cameras, operators, hours, locations, deliverables and revisions. Anything outside that scope, such as extra locations, additional hours, new deliverables or extra formats, is quoted separately and agreed in writing before it takes place.

3. Rates, overtime and expenses

Fees are quoted in US dollars. Additional hours beyond those contracted are billed at US$100 per hour plus ITBMS, unless the quotation states a different rate, and depend on the Producer’s availability. Travel and expenses (T&E), such as transport, accommodation or meals, are billed as shown in the quotation. Bank or transfer fees are added when the quotation states them.

4. Taxes, invoicing and payment

Panama’s ITBMS (7%) is added to invoices where it applies and is shown as a separate line. Unless a deposit applies as described in section 1, invoices are payable within 30 days of the invoice date, unless the signed quotation states a different term. Late payment may delay the delivery of files and the scheduling of new productions.

5. Access, permits and people

The Client is responsible for arranging access, permits and security clearances at airports, stores, venues and events, and for informing the Producer of any restriction on photography or video. Time lost to access delays, waiting or on-site changes counts as production time. Where a venue or brand requires image releases from people appearing in the content, the Client is responsible for obtaining them unless agreed otherwise in writing.

6. Rescheduling and cancellation

Requests to reschedule or cancel must be sent in writing. Cancellations of venue and event productions are accepted up to one month before the production date; later cancellations may be charged for the reserved time and for non-recoverable expenses already incurred. Rescheduling is accepted up to 72 hours before the production. If weather, venue closures, security restrictions or other circumstances beyond either party’s control prevent a production, it is rescheduled to a date agreed by both.

7. Delivery

Deliverables are provided as a digital gallery or download link, as described in the quotation. Delivery takes between 5 and 15 business days after the production date, as confirmed at booking. Galleries are available for a limited time, so the Client should download and archive the files on receipt. The Producer keeps a backup of final deliverables for a reasonable period but does not act as a long-term archive.

8. Revisions

The quotation states how many revision rounds are included (typically up to three). A revision is an adjustment to the delivered edit, such as selection, crop, color, timing or text, within the original scope. A new shoot, a reshoot or a new concept is not a revision. Additional rounds are quoted separately.

9. Retouching

Delivered photos receive standard professional editing: color, exposure and the clean-up of minor distractions, with natural-looking results. Compositing, background replacement, heavy beauty retouching and alterations to products are quoted separately.

10. Rights of use

The Producer keeps authorship and copyright of all work. Once the invoice is paid in full, the Client receives a non-exclusive licence to make commercial use of the delivered final files, crediting Chris Valencia Media as the author. Internal use does not require credit. Exclusive rights and resale of the files as such require a written agreement and may carry an additional fee. Unselected and raw material remains with the Producer.

11. Portfolio and confidentiality

The Producer may show delivered work in the portfolio, website and social media of Chris Valencia Media. The Client may ask in writing, before or after the production, that specific work is not shown or is removed, at no charge. The Producer does not publish unreleased products, campaigns or confidential set-ups before the Client’s public release or approval, and treats non-public information as confidential.

12. Liability and force majeure

The Producer is not responsible for delays or failures caused by events beyond reasonable control, such as severe weather, strikes, airport or venue restrictions, illness or equipment failure despite proper precautions. The Producer’s liability is limited to the fees paid for the affected production. The Client is responsible for damage to equipment caused by its staff or guests.

13. Privacy

When you contact us through this website or by email, we collect your name, email address, company and project details only to answer your request and prepare quotations. We do not sell this information. To ask for access to or deletion of your data, write to info@chrisvalencia.com.

14. Governing law

These terms are governed by the laws of the Republic of Panama. The parties will first try to resolve any dispute in good faith and, failing that, submit to the competent courts of Panama.
